Michael J. Malkiewicz has been a member of Barros McNamara Malkiewicz
& Taylor, P.A., since 1986. He is a Vietnam veteran,
honorably discharged from the United States Marine Corps in 1971.
He graduated from Delaware State University and the University of Notre
Dame School of Law in South Bend, Indiana.
Mr. Malkiewicz represents clients in the following
areas of practice: (a) personal injury, where he has represented
deceased and injured persons in automobile, truck, motorcycle, bicycle
and pedestrian accidents; (b) criminal defense, where he has
represented individuals and companies in felony level offenses in State
and Federal courts; (c) medical malpractice-negligence-abuse, where he
has represented deceased and other victims of medical
malpractice-negligence; and (d) nursing home and assisted living
abuse-malpractice, where he has represented deceased and other victims
of nursing home and assisted living malpractice-negligence-abuse.
Mr. Malkiewicz began his legal career working at the
Delaware Department of Justice. As a Deputy Attorney General for
five years, he was assigned in the Civil Division to represent the
Delaware Department of Insurance and the Delaware Natural Resources and
Environmental Control, and in the Criminal Division he was a prosecutor.
Mr. Malkiewicz’s current memberships in legal
and community organizations include: the nation’s premiere
organization for trial attorneys, the American Association for Justice,
and that organization’s sections on Nursing Home Litigation,
Motor Vehicle Litigation, and Professional Negligence; Delaware State
Bar Association; Delaware Trial Lawyers Association; National
Association of Criminal Defense Lawyers; former President and Member of
the Greater Dover Committee; Member of the Board of Directors of the
Central Delaware Chamber of Commerce, and its Legislative and
Accreditation Committees; and former President and Member of the
Colonial Rotary Club.
Between 1981 and 1991, while practicing law, he was
also an Adjunct Professor of Law at Wesley College in Dover, Delaware,
where he taught environmental and administrative law classes.
Mr. Malkiewicz is an experienced trial and
administrative attorney. He has tried numerous civil and criminal
cases in all the State and Federal courts in Delaware, and has appeared
before many State and local government agencies. In addition, he
has negotiated many civil and criminal cases to a conclusion that
satisfied his clients, who preferred not to go through a lengthy and
costly litigation or administrative process.
Mr. Malkiewicz is supported by an experienced and
dedicated legal team of paralegals, legal assistants, investigators,
photographers and experts, some of whom have worked with him for over
fifteen years.
Mr. Malkiewicz does not charge a consultation fee in
potential personal injury, wrongful death, medical malpractice, nursing
home or assisted living malpractice cases. He does charge a
consultation fee in criminal defense cases.
